Why Contract Renewal Matters — and How to Do It Properly

An employment contract is not a formality. It is the documented agreement that governs everything from your helper's salary to her rest days, annual leave, and the process for early termination. When the contract expires and nothing is signed to replace it, both parties operate in a legal grey zone — which benefits no one.

Contract renewal is the right time to revisit the terms. Has the salary been adjusted informally? Have duties changed? Are there rest day or leave arrangements that should be formalised? We help you capture the current reality of the employment relationship in a properly worded, signed contract — not just a rollover of the old one.

Contracts for Indonesian and Filipino helpers must also comply with the relevant bilateral agreement terms. We ensure the renewed contract meets these requirements.

What a Contract Renewal Covers

Key Terms to Review at Renewal

A domestic helper employment contract should specify: monthly salary, rest days and compensation arrangements, annual leave entitlement, sick leave, food and accommodation arrangements, duties and responsibilities, overtime arrangements if applicable, the notice period for termination by either party, and repatriation obligations at the end of the contract.

Any changes from the previous contract must be agreed by both parties before the new contract is signed — not imposed unilaterally. We facilitate this discussion where needed.

Coordinating with Work Permit Renewal

If the work permit and contract are both due for renewal at a similar time, we coordinate both processes simultaneously to reduce the administrative burden on you. See Work Permit Renewal for details on the permit process.

Bilateral Agreement Compliance

The employment contract for Indonesian and Filipino helpers must comply with the terms of the respective bilateral memoranda of understanding (MOU) between Malaysia and each source country. These MOUs set minimum standards that cannot be contracted out of. We ensure the renewed contract meets these standards.

Employment contract requirements are governed by Malaysian law and applicable bilateral MOUs, both of which are subject to change. Information accurate as of . General guidance only — not legal advice.

FAQs — Contract Renewal

What does a domestic helper contract renewal involve?

Preparing an updated employment contract that reflects any changes in salary, duties, or other terms, getting signatures from both parties, and ensuring the contract complies with Malaysian law and the applicable bilateral MOU. We prepare the contract and facilitate the signing process.

Can I adjust the salary or terms at renewal?

Yes, provided both parties agree. Contract renewal is the right time to formalise any changes that have occurred informally during the previous contract period. Changes must be documented in the signed contract.

Is contract renewal the same as work permit renewal?

No. The employment contract governs the employment relationship. The work permit is an immigration document. Both require renewal but through different processes. We can coordinate both simultaneously if they are due at a similar time.

What if my helper does not want to renew?

A helper has the right to end her employment at contract expiry. If she chooses not to renew, the work permit must be cancelled and she must be repatriated in accordance with her contract terms. We assist with the permit cancellation and repatriation process — see Permit Cancellation for details.
